For instance, while you may be able to avoid jail time following your first DWI/DUI conviction, it is still considered a class B misdemeanor ― meaning you may face substantial fines, required alcohol education classes and a license suspension. Keep in mind, this does not even include other possible consequences such as increased insurance costs and a criminal record.
However, these penalties quickly increase if you have a BAC of at least .16 percent or have a passenger under the age of 16 in the car, in which case you will be charged with aggravated DWI/DUI. Additionally, your punishment only gets worse with each subsequent DWI/DUI conviction.
